Cubix Terms Of Service

Welcome to Cubix Entertainment LLC (“Cubix,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of Cubix's consoles, websites, apps, stores, products, and services (collectively, the “Services”). By using our Services, you agree to these Terms. If you do not agree, you may not use our Services.

Eligibility and Account Registration

You must register an account to access certain features of our Services.

We offer both standard (13 and older) and child (under 13) accounts, subject to applicable laws, including the Children's Online Privacy Protection Act (COPPA).

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Products, Purchases, and Ownership

When you purchase an offline game from Cubix, whether developed by Cubix or a third party, you own a full, permanent copy of that game, not merely a digital license. This applies only to offline games. Online services or subscriptions may be subject to additional licensing terms.

We sell physical products (including consoles and merchandise) and offer subscriptions through our platforms. In-game purchases and store sales are subject to a 20% platform fee.

Refunds

Refunds for games and apps are available if:

The title has less than three (3) hours of playtime

or

The refund request is made within thirty (30) calendar days of purchase.

Physical products are subject to separate return policies.

User-Generated Content

Users may create and upload content (such as themes) on our Services (“User Content”).

You retain ownership of your User Content. By posting, you grant Cubix a royalty-free, worldwide, non-exclusive license to use, display, and advertise your User Content for marketing, community promotion, and operational purposes.

User Content must comply with our Community Guidelines.

Developer Content

Developers retain ownership of the games and apps they create.

Developers are subject to separate Developer Guidelines and agreements.

Cubix Ownership and IP

Cubix retains all rights, title, and interest in and to the Cubix brand, logos, platform software, and all related materials.

Community Conduct

You agree not to:

Violate any laws, regulations, or community standards.

Upload, post, or share any harmful, unlawful, offensive, or misleading content.

Attempt to hack, exploit, or disrupt our Services.

Impersonate others or misrepresent your identity.

Failure to comply may result in suspension, banning, or termination of your account at Cubix's sole discretion.

Termination

We reserve the right to:

Suspend, restrict, or terminate your access to the Services at any time, for any reason.

Remove or modify any content that violates these Terms.

Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind.

We do not guarantee that the Services will be uninterrupted, error-free, or secure.

To the fullest extent permitted by law, Cubix disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law:

Cubix shall not be liable for any indirect, incidental, consequential, special, or punitive damages.

Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

Dispute Resolution

Informal Settlement:
Before filing any claim or lawsuit, you agree to attempt to resolve any dispute informally by contacting Cubix at legal@cubixdev.org and engaging in good-faith negotiations.

Jurisdiction:
If the dispute cannot be resolved informally, it will be submitted to the courts located in Georgia, USA.

You agree that all disputes will be governed by the laws of the State of Georgia without regard to its conflict of law principles.

Changes to these terms

Cubix may update these Terms at any time. We will notify users of material changes by posting the new Terms on our website or by other reasonable means. Your continued use of the Services after changes are posted constitutes your acceptance of the updated Terms.
